Terms of use and sale

By using our websites, placing an order, booking an appointment or creating an account, you agree to these terms and to our privacy policy. If you don't agree, please don't use our sites.

These terms cover hokedesigns.com and our other sites. Web design, hosting and other client projects are governed by their own written agreement, which takes priority where it differs from these terms.

1. Who can buy

You must be at least 18, or have a parent or guardian's permission, to place an order or book a paid service.

2. Sample businesses and demonstrations

Some of our sites show features working live. The businesses on reservations.hokedesigns.com (such as Harborline Kayak Tours and Spruce & Fern Salon) and many events on events.hokedesigns.com are samples, not real businesses or events. You can book or RSVP to see how it works, and you'll receive the real confirmation email, but no one will be expecting you and no service will be provided. Sample bookings and RSVPs are deleted automatically, and every sample page is labeled.

3. Accounts

If you create an account, for example for our courses, keep your sign-in details private and give accurate information. You're responsible for activity under your account, and we may suspend accounts that are misused.

4. Orders, prices and payment

• Prices are in U.S. dollars. Sales tax and shipping are added at checkout.
• Sales tax: we collect City and Borough of Juneau sales tax (5%) on orders delivered in Juneau.
• Your order is an offer to buy, and we accept it when we send your order confirmation. We may decline or cancel an order, for example if a price or description is wrong or an item is unavailable. If we do, we refund anything you paid.
• Payments are processed securely by Stripe.

5. Prints

• Every print is made to order by our professional print lab and shipped straight to you.
• Screens show color differently, so a print may look slightly different from the image on your monitor. The "on a wall" preview is an illustration to help you choose a size, not an exact rendering.
• Sizes refer to the longest edge. The other edge depends on the photo's proportions.
• Delivery, damage and returns are covered in our shipping and returns policy.

6. Photo copyright and licensing

• All photographs on our sites are © Hoke Designs, all rights reserved.
• Buying a print gives you ownership of that physical print to display. It does not transfer copyright or any right to copy, scan, reproduce, resell or use the image commercially.
• Buying a digital photo download gives you a personal, non-exclusive, non-transferable license to use the file for personal, non-commercial purposes, such as printing it for your home or using it as a desktop background. You may not resell or redistribute it, use it in advertising or products, or use it to train artificial intelligence models without our written permission.

7. Plugins and other digital products

• Our WordPress plugins are licensed under the GNU General Public License, version 2 or later. The GPL governs the software's code; your purchase also includes a license key for updates and support.
• Each product page shows how many websites a license covers, how long updates and support last, and whether the license renews automatically. If it renews, you can cancel at any time and keep using the version you have.
• Digital products are delivered by download link or license key right after payment.
• Refunds for digital products are covered in our shipping and returns policy.

8. Appointments and services

• When you book one of our services, we'll confirm the time by email. The cancellation terms for each service are shown when you book.
• Drone and outdoor photography depend on weather and airspace rules. If it isn't safe or legal to fly, we'll reschedule at no charge.
• Larger projects are covered by a separate quote or agreement.

9. Events

We may change or cancel events we organize. If an event you registered for changes, we'll let you know by email, and we'll refund any fee you paid for a cancelled event.

10. Our content

The text, design, graphics, photos, video and code on our sites belong to Hoke Designs or the people who license them to us, and are protected by copyright and trademark law. You may view our pages and share links to them, but you may not copy or reuse our content without permission, except code released under an open-source license.

11. Content you send us

When you upload an assignment, leave a comment or send us material, you keep ownership of it. You give us permission to store and use it to provide the service you asked for, such as grading a course assignment. Please don't send anything unlawful, or anything you don't have the right to share.

12. Acceptable use

Don't misuse our sites. That includes trying to break in, overloading our servers, scraping content in bulk, sending spam through our forms or interfering with other visitors.

13. Other websites

Our sites link to and use services from other companies, such as Stripe, Google and our print lab. Their own terms and privacy policies apply to what they do.

14. Disclaimers

Our websites and demonstrations are provided "as is." We work to keep them accurate and available, but we don't promise they will be error-free or uninterrupted. This doesn't limit any rights you have by law as a consumer, including warranties on products you buy.

15. Limitation of liability

To the extent the law allows, Hoke Designs is not liable for indirect, incidental or consequential losses arising from your use of our sites. Our total liability for any claim about a purchase is limited to the amount you paid for it.

16. Governing law and disputes

These terms are governed by the laws of the State of Alaska. If you have a problem, contact us first and we'll try to resolve it informally. If we can't, disputes will be heard in the state courts in Juneau, Alaska, unless the law where you live gives you the right to bring a claim there.

17. Changes to these terms

We may update these terms. The version posted when you place an order or make a booking is the one that applies to it.
